Government Procurement Law

Section 11. Specifications. - Specifications for the procurement of goods, as well as the goods component of Infrastructure Projects and Consulting Services, shall be based on any or a combination of the following: relevant characteristics; performance or functionality requirements; or product or service standards specified by appropriate government entities or similar international bodies.

Reference to a brand name shall not be allowed except for reasons of technical compatibility, interoperability, servicing,maintenance, or preservation of supplier warranty in order to keep the performance, functionality, and useful life of the equipment, in which case, the Procuring Entity shall indicate the reasons or justifications for availing the exception.
